What information are we receiving under these circumstances?  Is it the truth, or false info given in order to stop the fear/pain?  

So--in your eyes--an AMERICAN follows through with an attack based on morals they've adopted from groups against the US government... fair trial.  The Bill of rights says so.

A FOREIGNER plans a similar attack, follows through-- and because it is now "an act of war"--they can be tortured, and any action to bring the trial on US soil is UnAmerican.  

What of the Geneva Convention??  Is that not an agreement we should be following on the world stage just as we follow our own Constitution here in the US??

What if a US soldier was captured in Afghanistan and subsequently tortured and horribly MURDERED to gain information?  We're at war... right??  What if the Blackwater employees who killed 17 Iraqi civilians were seized and beaten and tortured to death... would you be alright with that??  If the rights of foreigners now depends upon the "benevolence of the US government" are we, then, counting upon the benevolence of other nations??  I'm pretty sure I'd rather count upon the UN.

Profiling.

Profiling is a thin line.  If we're talking human beings with an affiliation with Al Quaeda or known ties with anarchist groups... then yes.  "Profiling" is OK.  Once we venture beyond that, and begin strip searching every Muslim, every person of Middle Eastern descent... then you're violating human rights.  

I feel if we fall into the realm of "profiling," soon their will be chaos every time an Arab tries to board a Subway... and for the overwhelming majority of US citizens of Middle Eastern descent... they're just trying to live life-practicing a different culture.  Praying differently.  Looking a little differently.  BUT ENTIRELY HARMLESS.  Once we travel this slippery slope these men and women will be demonized.

Your milk example is great.  Efficient.  Wonderful.  Except... completely lacking the human element.

Your business man vs drunk hobo example is great too.  Except a business man can be JUST AS DANGEROUS as the hobo once he's drunk too.  Let's talk apples to apples here.

However I would have trouble applying this to natural rights that are inherent in each of us and not bestowed upon us by the government, specifically each persons life and their property.

Every single person regardless of where their home country is should have these rights respected and if we intend to infringe upon these rights we must give them due process.

Just because someone is foreign do they lose their natural rights. So I think when you say that we only treat people with respect only because of the "benevolence of the U.S. Government and they can be rescinded" is a dangerous way of thinking about things.

Would you argue that the government if it so chooses can execute every fifth person who enters the United States just because it decides that it will not grant them the right to their life? Or perhaps that they will lock them up indefintily and perhaps torture them, actually I am sorry use advanced interrogation techniques upon them? Or a less extreme measure, that while in the country every foreign national bears the risk of the government taking their propety for no reason other than it decides it wants it?

I would most certainly reject all of the above statements on the grounds that it is an infringment upon the natural rights of men. If the government wants to do these things it must follow the laws of the land to do these things.
